Terms of Service

These Terms of Service ("Terms") govern your use of Arshes ("the App"). Please read these Terms carefully before using the App. For information on how we handle personal data, please refer to our Privacy Policy.

1. Service Overview

The App is an iOS application that allows you to apply real-time effects to camera footage using shaders. Users can create, save, and share shader code ("Content") with other users.

2. Accounts

An account is required to use certain features of the App. Users under the age of 13 are not permitted to use the App. The developer reserves the right to suspend or delete accounts that violate these Terms without prior notice.

3. User Content

• Copyright of Content created by users belongs to the respective users.
• When a user sets their Content to "public," it is made available under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). This allows other users to copy, modify, and redistribute the Content for any purpose, including commercial use, provided they give appropriate credit and distribute derivatives under the same license.
• If a user specifies custom license terms within their code, CC BY-SA 4.0 does not apply and only those custom terms govern the Content.
• Even if a user changes their Content from public to private, licenses already obtained by other users during the public period are not revoked.
• Posting content that is illegal, harmful, or infringes on third-party rights is prohibited.

4. Platform License

Users grant the developer a non-exclusive, royalty-free license to use Content posted to the App to the extent necessary for server storage, delivery and display to users, and creation of backups.

5. Prohibited Activities

• Unauthorized use or reverse engineering of the App
• Harassment or disruptive behavior toward other users
• Actions that interfere with the operation of the service
• Intentionally creating or publishing Content that causes app crashes or excessive load
• Infringement of copyrights, trademarks, or other intellectual property rights of third parties

6. Content Moderation

• Users may report Content that violates these Terms or is otherwise inappropriate using the in-app reporting feature or by contacting arshesofficial@gmail.com.
• Users can block other users using the in-app feature.
• Upon receiving a report or discovering a violation, the developer may review and take necessary action, including removal of the Content.
• The developer reserves the right to remove Content that violates these Terms without prior notice.

7. Execution of Content

Except in cases of willful misconduct or gross negligence by the developer, the developer is not liable for any device malfunctions or crashes caused by the execution of Content created or used by users. Users execute Content at their own risk.

8. Service Modifications, Interruptions, and Termination

The developer may modify or suspend the service. In the event of service termination, users will be notified with reasonable advance notice. Except in cases of willful misconduct or gross negligence, the developer is not liable for any damages resulting from such actions.

9. Disclaimer

The App is provided "as is." The developer makes no express or implied warranties regarding the App's operation or data integrity.

The developer strives to maintain Content compatibility, but app updates may cause Content to no longer function correctly. Compatibility is not guaranteed.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

11. Changes to Terms

The developer may modify these Terms. In such cases, users will be notified in advance through the App or other appropriate means. Continued use of the App after notification constitutes acceptance of the revised Terms.

本利用規約（以下「本規約」）は、Arshes（以下「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただく前に、本規約をよくお読みください。個人情報の取扱いについてはプライバシーポリシーをご参照ください。

1. サービスの概要

本アプリは、シェーダーを用いてリアルタイムにカメラ映像にエフェクトを適用できるiOSアプリケーションです。ユーザーはシェーダーコード（以下「コンテンツ」）を作成・保存し、他のユーザーに公開・共有することができます。

2. アカウント

本アプリの一部機能の利用にはアカウントの作成が必要です。13歳未満の方は本アプリをご利用いただけません。開発者は、本規約に違反するユーザーのアカウントを事前の通知なく停止または削除する権利を有します。

3. ユーザーコンテンツ

• ユーザーが作成したコンテンツの著作権は、当該ユーザーに帰属します。
• ユーザーがコンテンツを「公開」に設定した場合、そのコンテンツは Creative Commons 表示-継承 4.0 国際ライセンス（CC BY-SA 4.0） の下で提供されます。これにより、他のユーザーは適切なクレジットを表示し、同じライセンスの下で、商用・非商用を問わずコンテンツを複製・改変・再配布することができます。
• ユーザーがコード内に独自のライセンス条件を明記した場合、CC BY-SA 4.0は適用されず、そのライセンスのみが適用されます。
• 公開設定を非公開に変更した場合でも、公開中に他のユーザーが取得したライセンスは取り消されません。
• 違法、有害、または第三者の権利を侵害するコンテンツの投稿は禁止されています。

4. プラットフォームライセンス

ユーザーは、本アプリに投稿したコンテンツについて、サーバーへの保存、ユーザーへの配信・表示、およびバックアップの作成に必要な範囲において、開発者に対し非独占的かつ無償のライセンスを付与するものとします。

5. 禁止事項

• 本アプリの不正利用またはリバースエンジニアリング
• 他のユーザーへの嫌がらせや迷惑行為
• サービスの運営を妨害する行為
• 意図的にアプリのクラッシュや過負荷を引き起こすコンテンツの作成・公開
• 第三者の著作権、商標権その他の知的財産権を侵害する行為

6. コンテンツモデレーション

• ユーザーは、本規約に違反するコンテンツや不適切なコンテンツを発見した場合、アプリ内の通報機能または arshesofficial@gmail.com まで通報することができます。
• ユーザーは、アプリ内の機能を使用して他のユーザーをブロックすることができます。
• 開発者は、通報を受けた場合または自ら発見した場合、確認の上、該当コンテンツの削除その他必要な措置を取ることができます。
• 開発者は、本規約に違反するコンテンツを事前の通知なく削除する権利を有します。

7. コンテンツの実行

ユーザーが作成または利用するコンテンツの実行により生じた端末の不具合やクラッシュ等について、開発者の故意または重過失による場合を除き、開発者は責任を負いません。コンテンツの実行はユーザーの自己責任で行うものとします。

8. サービスの変更・中断・終了

開発者は、本サービスの内容を変更し、または本サービスの提供を中断することができます。本サービスを終了する場合は、合理的な期間をもって事前に通知します。これによりユーザーに生じた損害について、開発者の故意または重過失による場合を除き、開発者は責任を負いません。

9. 免責事項

本アプリは「現状のまま」で提供されます。開発者は、アプリの動作やデータの保全について、明示的または黙示的な保証を行いません。

開発者はコンテンツの互換性の維持に努めますが、アプリの更新によりコンテンツが正常に動作しなくなる可能性があり、互換性を保証するものではありません。

10. 準拠法および管轄裁判所

本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

11. 規約の変更

開発者は本規約を変更することがあります。変更する場合は、アプリ内またはその他適切な方法で事前に通知します。通知後も本アプリの利用を継続した場合、変更後の規約に同意したものとみなします。
